1. Definitions and terms

1.1. Website/Platform refers to www.sqaner.com

1.2. Service refers to peer to peer renting facility provided by the website.

1.3. Lender refers to the registered user of the website who has listed an item for rent.

1.4. Renter refers to the registered user of the website who has rented or is renting an item from the lender.

1.5. Product/Service/Rented Item refers to the item listed by the lender and rented by the renter.

1.6. Rental Period refers to the duration for which the renter is renting the item.

1.7. Rental Fee refers to the fee paid by the renter to the lender for renting the item.

1.8. Security Deposit/Bond refers to the security deposit/bond paid by the renter to the lender (held by Sqaner) as a security for any damages, loss, clean up fee or late return of the rented item.

1.9. Drop-off/Pick-up refers to the delivery or collection of the rented item by/to renter/lender.

1.10. Agreement refers to this Peer-to-Peer Rental Agreement.

2. Entering in the agreement

2.1. This agreement is automatically generated and becomes legally binding when the renter clicks "Rent Now" and makes the payment, and the lender accepts the rental request on the website.

2.2. The renter and the lender must agree to the terms and conditions of this agreement.

2.3. The agreement is between the lender and the renter. Sqaner is not a party to this agreement and does not hold any liability.

2.4. A copy of this agreement is sent to both parties via email and or is available in the user account on the website.

3. Details of the items

3.1. The lender has listed the item with details, photos, and condition on the website.

3.2. The renter has reviewed the details, photos, and condition of the item and agrees to rent the item in its current condition.

3.3. The item must be returned in the same condition as received (excluding reasonable wear and tear).

4. Rental period

4.1. The rental period begins when the renter confirms the drop-off or pickup on the website, or at the specified date/time in the rental request, whichever is earlier.

4.2. The rental period ends when the renter confirms the drop-off or the lender confirms the pickup/drop-off on the website.

4.3. Any extension of the rental period must be discussed and agreed upon by both parties and processed through the website.

4.4. Late return of the item will incur additional fees, which may be deducted from the security deposit/bond.

5. Rental fee

5.1. The rental fee is specified in the rental request and is paid by the renter through the secure payment system on the website.

5.2. The rental fee is released to the lender after the rental period ends and the drop-off is confirmed by both parties.

5.3. Sqaner deducts a service fee from the rental fee before releasing it to the lender.

6. Security deposit/bond

6.1. The security deposit/bond is specified in the rental listing and is paid by the renter at the time of making the rental payment.

6.2. The security deposit/bond is held securely by Sqaner during the rental period.

6.3. The security deposit/bond is refunded to the renter after the rental period ends, provided the item is returned in the same condition.

6.4. In the event of any damage, loss, clean up fee or late return, the lender can make a claim against the security deposit/bond.

6.5. If the claim is approved, the claim amount will be paid to the lender, and the remaining balance will be refunded to the renter.

7. Product condition

7.1. The lender has ensured that the listed item is in good working condition and fit for the intended purpose.

7.2. The renter has inspected the item upon receiving it and reported any discrepancies to the lender immediately.

7.3. The renter agrees to return the rented item in the same condition as received. Upon return of the item, both parties must assess the item before confirming the drop-off on the website.

7.4. The renter is responsible for any damage or loss of the rented item and agrees to pay for repairs or replacement costs which may be charged by the lender and may exceed the security deposit.

7.5. The lender has clarified the current condition of the item in the item details page and or in the additional clauses section of this agreement.

7.6. Any accessories, user manual or necessary support items have been added in the package (which usually comes with the item when first received as end user). These are mentioned in the additional clauses section of this agreement.

8. Use of rented product

8.1. The renter must use the rented item solely for personal or commercial purposes, as specified in the rental listing on the website.

8.2. The renter shall not sublicense, assign, or transfer the rented product/service to third party.

8.3. Any item rented from this website, cannot be used for illegal purpose.

9. Maintenance and repairs

9.1. The lender has ensured that the listed item is in good working condition and fit for the intended purpose at the time of rental for the whole rental period.

9.2. In the event of any malfunctions or defects during the rental period, the renter must notify the lender.

9.3. The lender agrees to undertake necessary repairs or replacements, or the rental agreement will be dismissed at that very point of time.

10. Cancellation and refunds

10.1. Any of the parties may cancel the rental upon discussion and must notify Sqaner.

10.2. Additional charge may be required to cancel the rental agreement.

11. Delivery and pick-up

11.1. The lender and the renter have agreed on the pick-up or delivery options.

11.2. The renter must be present at the specified location for receiving the delivery or the renter must pick-up the item where pick up service is available.

11.3. The renter may need to produce government issued ID to prove identity while receiving the item from lender.

11.4. If the renter is not able to collect the item, must nominate an agent.

12. Renter’s and lender’s liability

12.1. Lender is liable for providing a fault free item (unless details provided).

12.2. The renter is responsible for maintaining the rented item during the rental period.

13. Dispute

13.1. Should any dispute arise from rental process, the lender and renter must solve the dispute by themselves.

13.2. Sqaner does not hold any position in this agreement and solving any matter.

14. Governing law and jurisdiction

This agreement shall be governed by and construed in accordance with the individual laws of the state or territory of Australia where the rental transaction has taken place. Any disputes arising under or in connection with this agreement shall be subject to the exclusive jurisdiction of the Local and Federal courts.

16. Modification of terms

This agreement can not be modified after signed.
